1. scope of application
These General Terms and Conditions (GTC) apply to all direct bookings of holiday accommodation via our website www.tierravivatranquila.es (hereinafter "Website") between the guest (hereinafter "Customer") and Tierra Viva Tranquila (hereinafter "Provider").
2. booking and conclusion of contract
When the booking process is completed on our website, a binding rental contract is concluded between the provider and the customer. The customer receives a booking confirmation by e-mail.
3. terms of payment
Full payment (100 % of the total amount) is due within 14 calendar days of booking. If payment is not made on time, the provider reserves the right to cancel the booking.
4. cancellation conditions
Cancellation free of charge is possible up to 30 calendar days before arrival possible.
In the event of cancellation less than 30 days before arrival the entire amount will be retained.
Cancellation must be made in writing by e-mail to kontakt@tierravivatranquila.es to take place.
5. arrival and departure
The regular arrival time is from 16:00, the departure time until 11:00 at the latest.
Deviations are only possible by arrangement.
6. use of the accommodation
The accommodation may only be used by the number of people stated in the booking. Subletting or commercial use is not permitted.
The customer undertakes to treat the accommodation and the inventory with care.
7. deposit
The provider reserves the right to demand a deposit. This will be refunded within 7 days of departure upon proper handover.
8. damage & liability
The customer is liable for any damage caused. The provider is not liable for loss of or damage to the customer's personal belongings, not even in the event of burglary or theft.
9. force majeure
If the stay cannot take place due to force majeure (e.g. natural disasters, official orders, pandemics), the customer will be issued with a voucher for a later stay. No refund will be made in such cases.
10. data protection
The collection and processing of personal data takes place exclusively for the processing of the booking and in accordance with our privacy policy, available at: www.tierravivatranquila.es/datenschutz
11 Place of jurisdiction & applicable law
The law of the Kingdom of Spain shall apply. The place of jurisdiction is Cádiz, provided that there are no mandatory legal provisions to the contrary.
12. severability clause
Should individual provisions of these GTC be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
